Journée Mondiale d'action pour le Travail Décent


Et oui, c'était hier. On a retenu en France les manifestations autour des mots d'ordre d'emploi et de pouvoir d'achat. Mais cette journée était d'abord une journée internationale, lancée à l'initiative de la Confédération Syndicale Internationale. En Espagne, c'était une mobilisation contre la directive européenne sur le temps de travail autorisant les 65 heures hebdomadaires. Au Niger, c'est la répression de la mobilisation en faveur du travail décent. C'est un appel à mobilisation au Congo Brazaville, à Fidji, en Russie, au Rwanda ou en Colombie. Il faudra un peu de temps pour faire le bilan des différentes mobilisations. Mais ce principe des journées mondiales d'action est fondamentalement le bon.

L'ouvrage "Mondialiser le Travail Décent" coordonné par Arnaud Zacharie et Alexandre Seron du CNCD vient de sortir!

Il rassemble plusieurs contributions issues d'un séminaire sur la Mondialisation et le travail décent organisé à Bruxelles en juin dernier. J'y avais fait une présentation sur l'impact de la Mondialisation sur les Normes du Travail.

La Banque Mondiale et les Normes Fondamentales du Travail

Intégrer les normes fondamentales du travail et le travail décent dans les stratégies de développement préconisées par la Banque Mondiale, il s'agit d'un enjeu majeur tant les capacités de financement de la Banque Mondiale peut servir à améliorer de manière effective le respect des droits fondamentaux des travailleurs. Sur le sujet, la politique de la Banque Mondiale oscille entre les bonnes intentions et les a-priori "pro business". Le résultat: un ensemble peu cohérent ou la politique de promotion des normes du travail mis en avant par la Banque entre en pleine contradiction avec les recommandations visant à réduire les "rigidités", considérées comme un obstacle à l'investissement privé.

Le résultat de cette contradiction est certainement le rapport Doing Business qui vise à mesurer le niveau de réglementation des affaires. La question du droit du travail et de la protection sociale constitue un des éléments principaux de la notation. Cela donne le classement suivant :





Le problème constitue, comme le souligne la Confédération Syndicale Internationale, le critère "Embauche des Travailleurs" qui valorise les faibles taux d'emploi permanents et de protection sociale. Résultat: les pays le plus valorisé selon cet indicateur sont également les "mauvais élèves" à l'Organisation Internationale du Travail.

"L’édition 2009 de Doing Business (Pratique des affaires), publication à plus fort tirage de la Banque mondiale, qui a paru aujourd’hui à Washington, concède à des pays qui n’ont pas ratifié les conventions de l’OIT le titre de meilleure performance mondiale selon l’indicateur « Embauche des travailleurs ». _ Doing Business 2009 renoue, par ailleurs, avec la pratique consistant à faire des assertions non fondées de causalité entre son indicateur « Embauche des travailleurs », qui accorde les meilleurs scores aux pays ayant le plus faible taux d’emploi permanent et de protection sociale, et la bonne performance économique, alors que même l’organisme de contrôle interne de la Banque n’a pas relevé de preuve de l’existence d’un quelconque rapport entre les deux."


L
a Banque Mondiale assure pourtant qu'une "plus grande flexibilité sur le marché du travail ne remet pas en cause la capacité des pays à ratifier et respecter les normes fondamentales du travail". A regarder le classement relatif à cet indicateur, cela ne semble pas flagrant:

On aura beaucoup parlé du contexte politique dans lequel se sont tenus ces Jeux olympiques. Pourtant, si certains débats ont fait l’objet d’abondants commentaires, la question des droits sociaux et des conditions de travail en Chine a été passée sous silence. Il s’agit toutefois d’un enjeu central, en Chine mais aussi dans le reste du monde.

Premier problème : les conditions de travail dans les usines fournissant directement des produits portant le logo olympique ou dans la construction des installations olympiques. La campagne PlayFair 2008, coordonnée par la Confédération syndicale internationale (CSI) et des ONG, avait pourtant interpellé le CIO, les comités olympiques nationaux et le gouvernement chinois sur ces questions, demandant notamment de mettre fin à la répression syndicale, à la discrimination contre les travailleurs migrants, et appelant au respect des normes fondamentales du travail.

En 1998, le CIO signait avec l’Organisation internationale du travail (OIT) un accord de coopération sur la justice sociale, stipulant notamment : «Le CIO et l’OIT s’engagent à encourager les activités visant à poursuivre cet objectif, en particulier en ce qui concerne l’élimination de la pauvreté et du travail des enfants.»

Pourtant, le CIO a rejeté toute responsabilité concernant le suivi des conditions de travail des produits de merchandising labellisés «Jeux olympiques». Alors que la charte olympique prévoit une «attention responsable pour les questions environnementales», aucune mention n’a été faite du respect des droits fondamentaux des travailleurs. Face à ce déni de responsabilité, les entreprises ont eu toute liberté d’utiliser le logo olympique en violant les droits élémentaires des travailleurs, mettant en danger leur sécurité et le développement social des populations. Un rapport de PlayFair 2008 (1), qui a enquêté dans quatre entreprises exploitant le logo olympique, révèle un «mépris pour la santé des travailleurs et pour les législations sociales locales dans les domaines suivants : nombre d’heures travaillées, embauche de mineurs et d’enfants, conditions de santé et de sécurité». Dans un communiqué récent, la CSI dénonce «l’inaction déplorable du CIO en matière de droits des travailleurs».

Plus largement, les autorités chinoises avaient déclaré au moment de l’obtention des Jeux olympiques que ces derniers permettraient «le progrès social et le développement économique, ainsi que l’amélioration de la situation des droits de l’homme». Ces Jeux auraient pu être l’occasion de renforcer la pression sur les autorités chinoises pour qu’elles mettent fin à la répression syndicale et s’engagent à améliorer tant le respect des normes fondamentales du travail que la santé et la sécurité au travail. En 2005, 127 000 personnes seraient décédées des suites d’accidents du travail. Selon la CSI, plus de 200 millions de Chinois souffrent d’au moins une maladie liée au travail. Le non-respect de la liberté syndicale et du droit à la négociation collective rend impossible tout progrès dans ce domaine. A minima, le CIO aurait dû exiger que l’obtention des Jeux soit liée à la ratification des conventions 87 et 98 de l’OIT concernant la liberté d’association et le droit à l’organisation et à la négociation collective.

Car les autorités chinoises ont bien pris conscience de l’insoutenabilité de la situation sociale et s’inquiètent de la multiplication des conflits sociaux, au point de s’engager dans un processus de réforme du code du travail. Elles reconnaissent ainsi 870 000 «troubles à l’ordre public» par an. Ces grèves et mouvements de protestation sont souvent liés à des problèmes sociaux ou à des violations des droits des travailleurs. Ils sont tout sauf isolés. Sur ce terrain, la communauté internationale, prompte à dénoncer les atteintes aux droits de l’homme en Chine, se fait plus discrète. Pourtant, il apparaît évident que les conditions de travail et les salaires en Chine ont des conséquences directes sur les conditions de vie des autres travailleurs, dans les pays en développement mais également dans les pays développés. Le nouveau code du travail chinois s’applique depuis le 1er janvier. Les représentants des employeurs européens ou américains ont eu, pendant le processus de discussion du nouveau code du travail, une attitude ambivalente, utilisant de manière à peine voilée la menace de la délocalisation. En 2005, la Chambre américaine du commerce à Shanghai (AmCham) publiait un rapport de 42 pages avertissant que le nouveau code du travail était susceptible de «réduire les opportunités d’emplois pour les travailleurs chinois (2)». La version révisée proposée par le gouvernement chinois en décembre 2006 semblait avoir rassuré les représentants des employeurs, certains se félicitant ouvertement d’un recul des protections envisagées. Malgré cela, le caractère protecteur du nouveau code du travail ne peut être nié : il impose une réglementation des conditions de travail, facilite les contrats à durée indéterminée et impose des compensations en cas de licenciement. Il permet même de nouvelles formes de négociations collectives, sans reconnaître toutefois la liberté de créer des syndicats indépendants. Pour Cai Chongguo, du China Labour Bulletin, cette absence de syndicats indépendants risque d’ailleurs d’empêcher la pleine application de la loi.

Le développement du droit social chinois devrait aller dans le sens des engagements de certaines grandes firmes multinationales en termes de responsabilité sociale des entreprises. Pourtant, des entreprises promptes à mettre en avant leur engagement social semblent ne pas s’accommoder des nouvelles dispositions du code du travail et de l’augmentation des salaires pouvant en découler. Ainsi, le 27 juillet, le président d’Adidas annonçait sa volonté de retirer progressivement sa production de Chine, déclarant que les salaires chinois étaient «progressivement devenus trop élevés». Si le parallèle n’est pas fait avec l’adoption du nouveau code du travail, la coïncidence est troublante. Bien que la législation aille directement dans le sens d’un meilleur respect des principes directeurs de l’OCDE ou des objectifs du Pacte mondial des Nations unies en matière de responsabilité sociale, Adidas semble considérer que cela va trop loin. Il est surprenant qu’une entreprise se déclarant «socialement responsable» ne s’accommode pas de législations allant dans le sens de ses engagements sociaux. Les grands équipementiers sportifs avaient pourtant signé, début juillet, un accord avec des syndicats et des ONG prévoyant d’explorer des approches communes pour l’amélioration des salaires à l’échelon sectoriel…

The Decent Work Imperative

Une tribune, publié par Project Syndicate, de deux responsables des Nations-Unis portant sur le travail décent, insistant sur la nécessité de coordination internationale sur la question.

Mondialisation et Travail Décent


Je serai à Bruxelles le 26 Juin prochain pour un séminaire sur la mondialisation et le travail décent organisé par le CNCD. Plus particulièrement, j'interviens dans un panel sur l'impact de la mondialisation sur les normes fondamentales du travail au côté de Guy Rider, secrétaire général de la Confédération Syndicale Internationale.

Biographie :

Rémi Bazillier est docteur en Economie du Développement de l’Université Paris 1 Panthéon-Sorbonne. Il sera à partir de la rentrée universitaire prochaine Maître de Conférence à l’Université d’Orléans. Il a travaillé dans le cadre de sa thèse sur les liens entre Normes Fondamentales du Travail et Développement Economique. Ses travaux ont fait l’objet de plusieurs publications. Dans un article publié dans la Revue World Development, il montre que les normes fondamentales du travail sont susceptibles de jouer positivement sur le développement par le biais d’un impact positif sur le revenu par habitant de long-terme. Dans des travaux publiés dans les revues Journal of Development Studies et Revue Française d’Economie, en collaboration avec Nicolas Sirven (IRDES), il met en avant l’existence d’une « Courbe de Kuznets sociale » avec un effet non-linéaire des normes sur les inégalités. Enfin, dans une publication dans la revue Régions et Développement, il propose une nouvelle approche des normes fondamentales du travail en termes de Bien public Mondial. Rémi Bazillier a également travaillé sur l’impact économique de la Responsabilité Sociale des Entreprises (RSE) par sa participation au réseau européen de recherche ESTER. Enfin, en tant que coordinateur du Global Progressive Youth Forum, il a participé aux réunions du Steering group de l’Alliance pour le Travail Décent.

Intervention :

Dans un contexte de mondialisation, de nombreux économistes mettent en avant la nécessité de ne pas remettre en cause l’avantage comparatif de certains pays en développement basé sur un faible coût du travail et de faibles normes. Pourtant, rien n’indique que de faibles normes du travail favorisent le développement de ces pays même s’il peut favoriser un avantage comparatif dans des biens intensifs en travail qualifié. Cela peut expliquer la persistance de violations des droits fondamentaux des travailleurs dans un contexte d’augmentation des échanges et de la production au niveau international. Pourtant, nous montrons que les déséquilibres sur le marché du travail, et les insuffisantes incitations en terme de productivité ou d’éducation peuvent nuire au potentiel de long-terme de développement. Nous proposons une nouvelle approche en terme de biens publics mondiaux appelant à de nouvelles réponses en terme de financement. La promotion des normes doit ainsi être directement intégrés aux politiques d’aide au développement et cette question du travail décent doit également être traitée au sein de la Banque Mondiale et autres banques de financement du développement.

Effets des clauses sociales dans les accords commerciaux: l'exemple de l'accord US-Jordanie

L’accord de libre échange entre les Etats-Unis et la Jordanie a été signé en 2000 et appliqué en 2001. La question du respect des normes du travail est directement intégrée à l’accord et fait l’objet d’un article spécifique (article 6). Il s’agit du premier accord commercial américain intégrant directement une clause sociale dans le contenu même de l’accord. Jusqu’alors, cela faisait l’objet, comme dans l’ALENA, d’un accord spécifique en marge de l’accord commercial proprement dit.

Cet accord de libre-échange prévoit que chaque partie doit s’assurer que les lois nationales soient en conformité avec les normes du travail internationalement reconnues et mentionne explicitement les conventions de l’OIT et plus particulièrement la déclaration sur les principes et droits fondamentaux au travail.

Lorsqu’une partie considère que l’autre partie ne respecte pas ses engagements, elle peut faire une demande de consultation. Si les deux parties ne trouvent pas de solutions dans un délai de 60 jours, la question est transmise à un comité joint (joint committee). Un panel est alors constitué, se formant de trois personnes : une personne nommé par chacune des parties et une personne nommé par les deux parties et faisant office de modérateur. Le panel a alors 90 jours pour présenter aux deux parties un rapport montrant si l’une des parties a manqué à ses engagements et proposant un moyen de résoudre le conflit. Après la présentation du rapport, le comité joint a 30 jours pour trouver une solution. Si aucune solution n’est trouvée, la partie subissant un préjudice peut alors «prendre toute mesure appropriée et proportionnée ».

Le mécanisme de résolution des différents est commun à toutes les dispositions de l’accord et inclut donc l’article 6 portant sur les engagements des parties en terme de travail.

L’accord est souvent cité comme un exemple de possibilité d’intégration efficace d’une clause sociale dans un accord commercial. Bhagwati (2001) dénonçait d’ailleurs une telle clause en considérant qu’elle pourrait servir de « modèle » pour d’autres accords, et in fine, à lever les objections à inclure une telle clause dans les règles de l’OMC.

Il semble toutefois trop tôt pour en évaluer les effets réels et beaucoup d’auteurs mettent en avant les obstacles qui empêchent une pleine application de l’accord.

  1. Les obstacles à une pleine application de l’accord

Selon Elliott (2003), l’objectif premier de l’accord de l’intégration d’une clause sociale dans l’accord de libre-échange semble être de trouver un « mécanisme commerce-travail politiquement acceptable » permettant l’adoption de l’accord dans son ensemble. Selon l’auteur, s’il est clair que l’article 6 est utile dans la mesure où il apporte un précédent appuyant l’idée de l’importance des normes du travail, il n’est pas clair qu’il permette une amélioration significative de l’application de ces normes.

Le principal risque viendrait du langage « vague » de l’article 17 portant sur les mécanismes de résolution des différends. L’auteur insiste sur le caractère très général de l’article 6 sur le travail, et considère qu’il est très peu probable qu’un différend lié aux obligations des parties en terme de respect des normes du travail arrive jusqu’au stade de la sanction. La plupart des paragraphes de l’article 6 précise uniquement que chacune des parties devait « s’efforcer » de s’assurer à ce que les lois nationales soient en adéquation avec les « normes du travail reconnues internationalement ». L’accord prévoit par ailleurs le respect de la souveraineté des Etats en matière de régulation sociale.

La difficulté d’imposer des sanctions est par ailleurs confirmé par Trebilcock & Howse (2005, p578) qui affirment que les Etats-Unis et la Jordanie se seraient mis d’accord par lettre sur le fait que les différends ne conduiraient pas à des sanctions.

L’AFL-CIO, le syndicat américain qui fut l’un des principaux promoteurs de l’intégration de cette clause sociale, regrette, par la voix de son président John J. Sweeney, que malgré « des centaines de violations des droits de travailleurs clairement documentées, aucun pays n’ait jamais testé les mécanismes d’application contenus dans l’article sur les dispositions liées au travail, et que les gouvernements se soient engagés à ne pas y avoir recours». (Solidarity Center, 2005)

Cependant, malgré le fait que les deux parties se soient engagées à ne pas avoir recours aux sanctions, il est clair que l’accord en lui-même autorise cette possibilité (Bolle 2001), et que l’échange de lettres entre les deux administrations n’ayant en rien altéré le texte de l’accord, peut ne pas engager les futures administrations américaines (Solidarity Center 2005).

  1. Des mécanismes incitatifs ? l’exemple des conditions de travail dans les zones industrielles qualifiées (« QIZs »)

La Jordanie a connu au cours des dernières années une augmentation significative de ses activités industrielles, notamment grâce à l’établissement des zones industrielles qualifiées (« QIZs ») israélo-jordaniennes. Dans le contexte de la mise en place de l’accord de libre-échange Etats-Unis Jordanie, la condition des travailleurs dans ces zones a suscité l’intérêt des ONG et du mouvement syndical américain. En mai 2006, le National Labor Committee, une ONG américaine, publiait un rapport dénonçant le travail forcé et les mauvaises conditions de travail dans cette zone (NLC 20006). En Septembre, l’AFL-CIO et l’Association nationale du textile demandait au gouvernement américain de lancer une procédure de règlement des différends en conformité avec l’accord de libre-échange Etats-Unis – Jordanie. Cette plainte mettait en avant le non-respect des normes internationales, ainsi que l’incapacité de l’Etat à faire appliquer sa législation sociale.

Il est impossible de dire si l’augmentation des activités industrielles suite à l’adoption du traité de libre-échange a détérioré les conditions de travail, notamment dans les QIZs. Certains pourraient considérer que la clause sociale n’a pas empêché de constater 5 ans après la mise en place de l’accord des cas de violations flagrantes des droits fondamentaux des travailleurs. Mais il est également possible que l’accord ait permis une sensibilisation plus grande des ONG et syndicats ayant provoqué une réaction des autorités.

En effet, la réponse des gouvernements américain et jordanien fut rapide. En septembre 2006, le gouvernement de Jordanie signait avec USAID un programme de formation sur le droit du travail comportant un programme spécifique sur les conditions de travail dans les QIZs. Le gouvernement a procédé à des fermetures d’usines et à des inspections et lancé un plan d’action comportant des réformes légales (augmentation du salaire minimum au 1er janvier 2007, réforme du code du travail (Ministère du Travail Jordanien, 2007).

Le département du Commerce américain a noté suite au rapport du NLC une baisse des importations jordaniennes de matériel (Elis 2008). Les autorités jordaniennes ont consécutivement pris de nouvelles mesures pour améliorer les conditions de travail dans les QIZs. Le NLC reconnaît les améliorations tout en restant vigilant sur l’application des nouvelles dispositions (NLC 2007).

Le gouvernement pour sa part a refusé de lancer la procédure de résolution des différends dans cette affaire mais a choisi de financer le gouvernement jordanien pour lui permettre d’assurer une amélioration des conditions de travail (NLC 2007b).

Cette affaire ne permettra donc pas de voir si le mécanisme de résolution des différends constitue un cadre adéquat pour permettre le respect des normes internationales du travail. Néanmoins, on peut supposer que les réactions américaines et jordaniennes n’auraient pas été les mêmes en l’absence d’une telle clause.

Local elections in France: Huge victory for the left

It was the first elections after the General elections last year. 10 months after the victory of Nicolas Sarkozy, the Left clearly won the local elections. The Right lose 38 large cities. François Hollande, learder of the Socialist Party, considered before the vote, that these elections would be a success for the opposition in the case of a victory in 30 cities. Toulouse, Strasbourg, Reims are now governed by the Left. Large victories also in Lille, with the former minister of employment Martine Aubry (66%) and Bertrand Delanoé in Paris (57%). We can also note the defeat of ministers: Darcos (Education) in Perigueux, Yade (Human Rights) in Colombe, Lagarde (Economy) and Albanel (culture) in Paris. Other fact: the electoral failure of MODEM, the new center party of François Bayrou. This party decided to make alliance au-cas-par-cas, with the left in Marseille, with the right in Toulouse or alone in Pau or Paris. The result? François Bayroy lose in Pau, the center in Paris will only have one seat in the council of Paris. The opposition considers it is clearly a sanction against the policy of the governement but the governement already declared that they will continue and foster the reforms..

Cameroon, the forgotten repression

Violent repression of the protests organized by the Social-Democratic Front (SDF) against the dictator Paul Biya and his decisoion to modify the constitution in order to allow a third presidential mandate. At least 12 killed people. The French foreign ministry keeps the silence on the issue. No condamnation. When you have a look to their website, the last release on Cameroon was published on july, 07th 2006, "for a dinner in honor of the President of the Republic of Cameroon, Paul Biya".

Chad and so What?

Before the official visit in South Africa, President Sarkozy makes a stop in D'jamena (Chad) to meet Iddriss Deby. For the ones who tought that the president changed the French policy in Africa, this visit will be very disappointing. Why? Because the government is suspected to have arrested and kidnapped leaders of the opposition during the attack of the rebels. We have no news from two of them since February 3rd and according to Human Rights Watch, the State security forces are directely responsible (See their statement here).

" The government says it doesn’t know how Yorongar and Ibni disappeared. Our inquiry leaves little doubt that it was the government which took them, and we hold the government fully responsible for their well-being and safe return. "

In these conditions, the visit of the French President is a very bad signal. Of course, the French authorities are arguing that Sarkozy will ask to Deby a clarification on this issue. He also proposed an international inquiry concerning this. But this is not enough and we can be sure this visit will be counterproductive. Deby will use it politically for his own political support without any guarantees for the opposition leaders. Deby must be condamned and the European authorities must cut the relationship with the dictorial regime until the opposition leaders are released.

Update on Serbia and Kosovo

A statement of my friends of SDU after the violences in Serbia. I would be curious to read a statement from IUSY.

OFFICIAL STATEMENT OF SOCIAL DEMOCRATIC UNION ON SITUATION IN SERBIA AFTER PROCLAMATION OF INDEPENDENCE OF KOSOVO

In the week after proclamation of independence of Kosovo, peace and stability in Serbia are seriously endangered. By tackles reactions, the ruling political parties have given a kind of support to citizens who expressed their rage by demolishing of diplomatic missions of USA and some EU states and offices of opposition parties, and oppressing of journalists. On Sunday, February 17, right after proclamation of independence by Kosovo Parliament, citizens who have spontaneously gathered attacked the Embassies of USA and Slovenia. SDU considers that in both cases the police reaction was unprompted and inappropriate and allowed rioters to demolish the Embassies, and even to enter the Embassy of Republic of Slovenia. Also, rioters have demolished central offices of Liberal Democratic Party and two McDonald’s restaurants and have tried to reach the building where Cedomir Jovanovic, the leader of LDP lives. Considering the fact that there were not more to 200 demonstrators, the police reaction had to be more efficient. We are especially concerned by reaction of some Ministers, who have given the support to violent demonstrations. In the following days, violent protests were organized in the north of Kosovo, a part with Serbian majority, where, by direct support of Serbian government, checkpoints Jarinje and Brnjak were blown up and several vehicles of KFOR and Kosovo police were burnt down. On Thursday, February 21st, the Government of Serbia, accompanied by some parliamentary parties, organized the protest named “Kosovo is Serbia”. Based on journalistic and police estimates between 150.000 and 500.000 citizens participated in the protest. Despite serious possibility of riots after the rally, “critical points” weren’t been protected well. After the rally several thousands of protestants went to the street with foreign diplomatic missions. In the riots the embassy of USA was burnt, and rioters have also tried to burn Croatian Embassy, when they had burnt the building next to the embassy building. Germany, Bosnian, Canadian and Belgium embassies were also stoned. The registration house in front of embassy of Great Britain was burnt. The rioters have again attacked McDonald’s restaurants and robbed several shops in the city of Belgrade. Lot of journalists were attacked, and one Dutch journalist was seriously wounded. The police reacted more then 30 minutes after starting of violence. However, the most tragic result of riots is death of 21 year old young man who was burnt in fire in the Embassy of the USA. SDU considers the organizers of the rally as directly responsible for this tragedy. Leaders of some political parties encouraged protestants on violence. They pointed opposition and some media as responsible for violence, because, as some politicians have said, “by their reports and political attitudes media and “pro Albanian” political parties have provoked citizens”. Officials of some parties have even accused LDP that, in cooperation with CIA, have organized violent demonstrations with an aim to send a bad image of Serbia abroad. SDU think that after proclamation of independence of Kosovo, Serbia is seriously destabilized and that it is not possible to predict which direction the political situation would develop. We demand the state officials to immediately stop violence against media and political opposition and to hold back from any activities that could produce riots with, maybe even worse consequences.

The future of Russia

Presidential elections in Russia. We already know that Dmitri Medveded, the official candidate supported by Putin will win. It is not an issue. The elections won't be fair and have not been fair until now. The real issue is what will be the behaviour of the newly elected president and his links with the future prime minister, Putin itself. We observed in the last days the first try of an emancipation. "Russia will stay as a presidential republic with one center of power". I remembered the strategy of Eltsine when he chose Putin. He wanted a non-charismatic guy that will be linked to his own interest. We know what Putin did with its heritage. Will we see the same rupture with Medvedev?

The independance of Kosovo, the only option

As it was foreseen, Kosovo unilaterally declared its independance last Sunday. After almost 9 years of full autonomy and de facto independance, there were no alternative to this solution. It is a political cycle which is closing, the last step of the dislocation of the former republic of Yougoslavia. After the independence of Montenogro last year, it should become a new political era for the Serbians. This issue of Kosovo has polluted the internal debate since years and the fascists and the nationalists gained support because of this situation. Now the situation is clear and the Democrats should not try to increase the political and diplomatic crisis. It should be the right moments for the Democrats to put the political and social priorities on other fields. Russia is using this at the moment to try to cut Serbia and the Serbian people to other Europeans. They already had an aggressive policy of acquisition of Serbian companies and ressources, they are just selling their political support to the Serbian Governement (in particular at the UN Security Council) to expand their political influence. It is now up to the Serbian people to decide what future they want, and it is time for the Democrats to be clear on their political priorities: do they want to strenghten the links with Kostunica, the prime minister, on a more and more nationalist point of view? Or do they chose the European future and to overpass this difficult debate on Nationalism to put the social issues at the top of the priorities? The welfare of the Serbians won't be improved with a Kosovo rattached to Serbia. What they need is more employement, better working conditions and better opportunities for the youth.

For Kosovo, challenges are just starting. They have to show that they are able to create a sovereign state, to build a fair justice and solid institutions. The EU has a strong role to play helping the new state to do so but it is mainly the responsability of the kosovars to decide. The place of the Serbian minority in the new institutions will be a test for the international community.

For the Europeans, they have an historical responsability. Unfortunately, the EU countries does not have the same position considering the recognition of the new state of Kosovo. Already six governements refused to recognize this state, mainly because of internal reasons. These divisions are killing any political will and we will need this will in the next future. If we want to avoid a new instability in the Balkans, the political message of the EU should be very strong, clear and united. We already know the nationalists will try to play the card of claiming the independence of Republica Serbka for example. This has to be a casus-belli for Europe. Never the EU will accept the independence of a state that would have been created throught the war in Bosnia. EU has to give political and economic perspective for the people of the region.

Tchad, Sarkozy et la Françafrique

Je reviens sur la crise tchadienne et la politique africaine de Sarkozy pour Cap Finistère. Voici la réponse aux questions posées. A lire également sur le sujet le post de Benoit Curinier et l'article du Monde Diplo.

Cap Finistère : Quel rôle joue l'armée française au Tchad ?

La France et le Tchad sont liés par un accord de coopération militaire technique depuis 1976. Cet accord prévoit la formation des militaires tchadiens, et l’assistance de la France en terme de renseignements et d’appui logistique. Le Tchad est au cœur du dispositif militaire français en Afrique. Il y a près de 1500 soldats français présents au Tchad, réparties sur trois zones militaires. Lors de l’offensive des rebelles, la France est dans un premier temps prudemment resté en retrait du conflit. Disons que l’intervention des troupes françaises n’a pas été aussi flagrante qu’en 2006, lorsque nos soldats avaient tiré sur des troupes rebelles qui avançaient vers N’Djamena. Ceci dit, une nouvelle fois, l’appui logistique et en terme de renseignements a été décisif pour permettre le maintien au pouvoir du dictateur tchadien. Les militaires français ont par ailleurs protégé l’aéroport et pris directement à des combats. Le gouvernement s’est par ailleurs activé pour obtenir du conseil de sécurité une condamnation de l’offensive des rebelles et un soutien inconditionnel à Idriss Déby. Ce qui fait sourire, lorsqu’on sait que le président tchadien est arrivé au pouvoir par un coup d’Etat militaire, alors soutenu par la France…

Cap Finistère : Peut-on parler de rupture dans la politique africaine française depuis l'élection de Nicolas Sarkozy ?

Il existe un décalage important entre les discours du chef de l’Etat, notamment ceux qu’il a prononcé pendant la campagne présidentielle et la politique africaine de l’Elysée. Le soir même de son élection, Nicolas Sarkozy s’empressait de téléphoner à Omar Bongo, le dirigeant gabonais, pour le remercier de son soutien. La première visite en Afrique du Président, qui devait marquer « la rupture » annoncée, ne se sera résumée qu’à une visite au Gabon et au Sénégal, deux piliers de la politique françafricaine, accueillant des bases militaires françaises. Alors que les socialistes s’étaient engagés à rediscuter publiquement les accords de sécurité et de défense et à les placer sous le contrôle du Parlement, on voit bien que ce n’est pas l’objectif du gouvernement actuel. L’ambiguïté de l’action française au Tchad pendant la récente crise a pourtant montré qu’une remise à plat de ces accords était urgente.

Cap Finistère : Comment sont perçus les premiers mois de la présidence Sarkozy en Afrique ?

Le discours de Dakar de Sarkozy sur « l’homme africain » a été très mal perçu par les populations africaines. Beaucoup y ont vu un retour en force d’un comportement néo-colonial et condescendant inacceptable. La politique d’immigration passe également très mal et le traitement accordé aux sans-papiers choque, et la politique des visas continue d’affaiblir les liens de beaucoup de jeunes africains à notre pays. La jeunesse africaine a une méfiance grandissante vis-à-vis de la France et les politiques de M. Chirac et Sarkozy y a beaucoup contribué.

My last IUSY congress..

This congress of IUSY was the last one for me. After two years of work within IUSY as coordinator for social movements and GPYF, the congress took a decision. The vote was clear. My organization and me do not share the same vision of a political youth movement with the majority of IUSY organizations (at least the ones that were at the congress). We fought since years for an international movement of young socialists more involved with the social movements, active within the social forum, with the trade unions, with the NGOs that have a real impact at the international level. We are not living in a bubble and our candidature was a clear message for a more open IUSY, open towards the international movement, towards a more active IUSY at the international level. It is what we tried to do in the past two years, with my involvement within the Decent Work - Decent Life campaign steering group, with the ITUC, with ActionAid on the fight against EPAs. We tried to develop concepts of actions and to give a real frame for action at the international level. But sometimes, the principle of political responsibility doesn’t seem to be the top priority of our movement. I don't have to hide what I did or what I did not in the past two years. It was the basis for future actions but the direction chosen by IUSY is the opposite one. Some will argue that they agree with us on this vision even though we disagreed on the vote. From our side, we never make a distinction between the political line and the strategic positions.

I am worried about an organization that cares more about its internal struggles and subtle balances than about the political goals we have outside the organization. IUSY can be much more than a playground for young leaders that want to practice their strategic skills.

I sincerely wish good luck to Jacinda Arden, the newly elected president. I wish all the best to Zita who is now responsible for social movements and GPYF, and to Kati as a feminist coordinator. I congratulate the newly elected presidium. All of them. Lots of them are friends. I am really happy for Judicael (Benin), for Silje (Norway), for Daniel (Chile), Uri (Israel), Pavel (Mexico) and some others. I'm sure they will make a great work within this presidium. I thank all the comrades with whom I have worked during these years of involvement at the international level. Don't worry, MJS France and its international team lead by Benoit Curinier will continue the fight for a certain vision of international activism. :-)

For me, I will continue my involvement at the international level through different ways, through the work of Fondation Jean Jaures and other think-tanks at the international level, through my work of development economist at university... I never saw the participation in the IUSY presidium as a goal as such, as an accomplishment to add one line to my CV. My organization and I wanted to bring something to IUSY. But it is still possible to be active and to make a difference outside of this international platform...

Bye bye Tony Blair!


As a French Socialist and PES activist, i was astonished by the participation of the former English prime minister Tony Blair to the national council of the right-wing party UMP, together with Nicolas Sarkozy. I thought that the UK Labour party was a sister party, member of the PES and the SI... At least, it is clear. Politically, it means something. It is true that Sarkozy and Blair share some points of view on the role of EU in the World and the relation with the United States. But it is also a challenge for the Party of European Socialist to be politically coherent. The drafting of the 2009 manifesto can be an opportunity to clarify our common visions based on a clear Left point of view.

Behind the participation of Tony Blair to the UMP national council, we have the candidature of the former British PM to the presidency of the European Union, supported by Nicolas Sarkozy. Clearly, this candidature can't be the one of the European Socialists. Last week-end, Tony Blair showed he was closer to the European Right-wing parties, and he won't be the candidate of a more social, federal and democratic Europe. The PES has to think on what would be his position regarding this election of a president of the EU and a possible alternative to the candidate of a neo-liberal and pro-NATO Europe. In France, this possible candidature was strongly critized within the Left (Pierre Moscovisci said he can't be the candidate of the Socialists) and the Right. Edouard Balladur and Valery Giscard D'Estaing said the next EU president should come for a country fully integrated in the EU (Euro, Schengen zone and Charter of Fundamental Rights). Well, it seems it will difficult for Tony!

EPAs: "Stop ou encore"

The Economic Partnership aggreements (EPAs) between the EU and the ACP countries shoud have been negociated until 31st of December 2007. But because of a strong opposition of most of African countries, no aggreements were found. The African countries feared the complete liberalization that would have followed the ratification of these aggreements. What are the problems?

  • The WTO aggreements ask for the reciprocity of the trade aggreements. If the EU accepts to open its markets to ACP countries, the ACP countries should open their markets to EU products. This is very problematic as the level of infrastructures, the production capacities and development of the countries cannot be compared. More flexibility should be given to this rule of reciprocity, both in the EPAs and at the WTO.
  • The WTO allows specific trade arrangements for the developing countries and least advanced countries. The EU initiative "everything but arms" concerned the least advanced countries. But it is not possible to have a specific aggreement for some of the developing countries (the ACP for example). However, we cannot compare the situation of Brazil, India and China from one side and Antigua and Barbuda, Burkina Faso and Lesotho from the other side.
  • EPAs should promote the regional integration. However, the EU does not let the time to the African countries to strenghten their sub-regional cooperation. Moreover, the EU always refused to involve South Africa in the negotiation (South Africa has a specific trade aggreement with the EU and are not part of the ACP aggreements). How to build a regional integration without South Africa?
  • Do the ACP countries need the full liberalization of their market? No. At least, it is not the priority. Lets help to build infrastructure and strenghten their productive capacity first. The problem is the partnership is not clear and ambiguous. The EU make the promise to increase the European Development fund, but the reality of the additional fund have to be proved.
  • The agenda was unrealistic. How to ask to ACP countries to fully open their market? It is impossible for some countries to evaluate the impact of these aggreements. First because they don't have yet statistics about their trade. More time is needed anyway.
For all that reasons, NGOs, trade unions and African countries are right to oppose these EPAs. (see the press release of ITUC). But the problem is wider. The WTO rules are also questionned and the ACP countries together with the EU should go there and negociate more flexibility on the rule of reciprocity for example. The EU has a lot of things to loose in these negotiations. So we must change urgently the shape of the negotiations.

Back from Baku - situation in Azerbaijan

I did not know very well the political situation in Azerbaijan. But this country plays a strategic role in the region due to its ressources in oil and gaz. The western countries try to use these ressources in order to minimize their energetical dependancies towards Russia. The pipeline BTC (Baku, Tbilissi, Ceyhan) is the longest in the World (1768 km) but transports 1 million of baril each day. When i was in Baku, the Azeri authorities celebrates the first baril of oil exported to the US via Turkey.

Azerbaijan is also one of the few countries of the region that did not face a "colored revolution" in the last years. And the lack of support from the international community (contrary to the neighbour country Georgia, where the US and western countries strongly supported the so-called "pink revolution") may come from the strategical role of the country. Azerbaijan is far to be a democracy. Freedom of speech is limited and a lot of journalists are in prison (the former SDYO (social-democratic youth organization) chairman is presently in jail. He was journalist in an opposition newspaper). The last elections in 2005 was a joke with massive irregularities (See the report of Human Rights Watch). And following the elections, the opposition went into the streets to ask for free and fair elections. But the repression of these demonstrations were masive without any protest from the international community. Why? Because the western countries need stability, and a "strong" political partner. The president Ilham Aliev presents these guarantees. The cynism of the international community ensures the stability of the regime..

Next elections will take place in October or November this year. But the comrades are very pessimistic. Most probably, nothing will change and Aliev will win without any difficulties these elections. Azerbaijan is one of the countries with the highest growth in the World (more than 30% of growth last years) due to the energetic ressources. Without a democratic regime, this growth won't be redistributed and massive inequalities are expected. This may become the main "danger" for the sustainability of the regime. But without a clear support from the international community, these evolutions will take time.

The paragraph on Our Values and Beliefs explicitly states that democratic socialism means nothing less than the programmatic horizon of social democratic objectives for the 21st century – the ‘first real global century’ according to the introductory time analysis."

The end of a tendancy in the European Left? We are far from the Blair-Schroeder message in this program. Read it here.

Clinton is back.. Towards a ticket Obama - Edwards?



Clinton 39%, Obama 36% and Edwards 17%. Obama had 10% more in the polls. How to explain this result? Is it a new evidence of the so-called Bradley effect ("Specifically, there have been instances in which statistically significant numbers of white voters tell pollsters in advance of an election that they are either genuinely undecided, or likely to vote for the non-white candidate, but those voters exhibit a different behavior when actually casting their ballots.")? Difficult to say. Anyway, this second place of Obama is a very good result. And more and more people are pushing for a ticket Obama - Edwards (even if the name of more veterans politicians also emerge like Jack Reeds).

General strikes in Guinea

After several weeks of a huge social and political crisis in January, a unity government was formed to solve the crisis. On 3 January, Justin Morel Junior, the Minister for Communication and New Information Technologies, was sacked by the President with no explanation given. Since last week demonstrations have been held in several of the country’s regions. The trade unions of Guinea called for unlimited general strikes starting on January 10th.

"The population is losing patience. The establishment of a transitional government in March 2007 had raised people’s hopes, however the changes awaited since then have been taking a long time to come, whilst living and working conditions have remained precarious. Justice also seems to be taking a long time to be done and the unions are critical of the dismissal for lack of evidence of the case against Mamadou Sylla, whose release sparked off a protest last year.

In a letter (FR - pdf) to the ECOWAS (Economic Community of West African States), the ITUC expressed its profound concern at the deteriorating socio-political situation in Guinea. The ECOWAS played an active role in the establishment of the transitional arrangements in Guinea and its support will be vital for guaranteeing peace, stability and democracy in this West African country."

Why the progressive should support John Edwards

Yes, i had to achieve my Ph-D. Lack of time, very difficult to update this blog. Sorry for this silence but in 2008, i'm coming back! With a blog more focused on international politics with more posts in English. We come back to the original idea of this blog. Let's see...

In 2008, a lot of things to follow at the international level. US elections, Situation in Middle-East (Peace talks in Israel - Palestine and situation in Lebanon), Trade negotiations in Africa, Latin America.
